Terms & Conditions.

By using art-app.org or any other products or services by Rambl Limited that link to these Terms (collectively "Services"), you agree to the Terms. These Terms form a legally binding contract between you and Rambl Limited.

You and Rambl limited agree that disputes between us will be subject to mandatory binding arbitration, and you and Rambl Limited waive any right to participate in a class-action lawsuit or class-wide arbitration.

www.art-app.org is a site (the "Website") owned and operated by Rambl Limited in the United Kingdom (“Rambl Limited” or "Rambl").

2. Who can Use the Services

By using the Services, you state that:​

  • You are legally capable of entering into binding contracts;

  • You are at least 13 years old;

  • You are not barred from receiving the Services under any applicable jurisdiction;

  • You have not been convicted of any sex crimes;

  • You agree and will comply with these Terms and all applicable laws, rules and regulations.

  • If you are using the Services on behalf of an organisation, you state that you are authorised to do so.

Any personal data that we gather concerning you shall be used only in accordance with our “Privacy Policy".

3. Rights We Grant You

Rambl Limited grants you the rights to use the Services for the sole purpose of enjoying the benefits of the Services in a manner that conforms to these Terms.

Copying, modifying, extracting the source code or monetising the Services in any way is strictly prohibited. 

4. Rights You Grant Rambl

4.1 You grant us a royalty-free, worldwide, transferable, sub licensable, license to store, display, reproduce, edit and distribute any content that you submit to the Services, for the purpose of providing and improving the Services.

 

4.2 Rambl reserves the right to limit certain functions of accounts and/or remove accounts entirely from our database. 

5. General Content

While we reserve the right to review or remove all of the content submitted to the Services, we do not take responsibility for any of the content that is submitted to the Services. 

6. Privacy

When you use our Services we handle your data in accordance with the Privacy Policy, which, among other things, allows us to collect, use and share your data.

7. Community

We aim to promote peace and general joy. By using the Services, you agree that:

 

  • you will not bully other users;

  • you will not violate anyone's intellectual property or rights of privacy and publicity;

  • you will not use the Services to commit any crimes or breach the Terms;

  • you will not damage or impair the functioning of the Services;

  • you will not hack or attempt to view to the source code of the services;

  • you will not attempt to mirror or copy in part Rambl’s database;

  • you will not upload viruses to the Services;

  • you will only use Rambl as is;

  • you will not modify the code or network traffic coming in or going out;

  • you will not upload content that contains or links to hate speech, violence or pornography.

8. Third Party Services

Rambl is not liable for services and products by third parties. Any use of products or services operated by third parties will be subject to other terms and conditions.

9. Transaction Fees

Rambl may charge transaction fees for Rambl’s goods and services when goods and/or services are sold on Rambl’s platform. We reserve the right to change these fees without prior notice.

10. Wallet

10.1 Funds in the wallet within Rambl are not guaranteed by Rambl and should not be considered actual money. Be advised to pay-out regularly to avoid potential loss.

 

10.2 Rambl reserves the right to temporarily block pay-outs from the wallet. Reasons may be security concerns or lack of funds by rambl to satisfy the pay-out.

11. Storage

Rambl does not guarantee the safe storage of images, video, audio, text and other materials. Rambl reserves the right to delete these. Rambl should not be considered a 'back-up' of data.

12. Disclaimers

We aim to provide a positive user experience, but we provide the Services on an 'as is' and 'as available' basis. We do not represent or warrant that the Services will always be (a) secure, timely or error-free; or (c) that any of the content that forms part of the Services is accurate.

13. Limited Liability

To the maximum extent permitted by law, Rambl Limited, as well as our shareholders, directors and employees, will not be liable for any loss of revenue or profits, damages, loss of data or other intangible losses, resulting from: (a) your use of the Services; (b) other users using the Services; or (c) any failure of the Services. Our maximum aggregate liability due to you for any claim, will be the higher of $50 and any amount you paid, if any, to us in the last 12 months.

14. Severability

If any of these Terms are determined by any competent authority to be unenforceable, such term or condition will to that extent be severed from the remaining terms and conditions which will continue to be valued to the fullest extent permitted by law. 

15. Jurisdiction

These Terms are governed by the law of England and Wales.
